• «ƺǕɖǼƏɎȒȸɵ ɯȒȸǸ The Decree modifying the regulatory part of the Public Health łķĸ ŇĴľĸŁ ļŁ ĴŃŃĿļĶĴŇļłŁ łĹ ŅķļŁĴŁĶĸ ӅӃӄӉіӄӅӋׇłĹ ӄӃׇ ĸĵŅňĴŅŌ ӅӃӄӉׇҎ ĸĶŅĸĸ ӅӃӄӋіӇӆӇׇļŁŇŅłķňĶļŁĺ ʼnĴŅļłňņ ŃŅłʼnļņļłŁņ ŊļŇĻ ŅĸĺĴŅķ Ňł ŁňĶĿĸĴŅ ĴĶŇļʼnļŇļĸņҏ ŊĴņ ŃňĵĿļņĻĸķ łŁ Ӈׇ ňŁĸ ӅӃӄӋє Ň ĶłŁŇĴļŁņ several provisions concerning the protection of sources against malicious acts, and more specifically: Ҋ the classification of ionising radiation sources and batches łĹ ŅĴķļłĴĶŇļʼnĸ ņłňŅĶĸņ ļŁŇł ĶĴŇĸĺłŅŌ ё ё łŅ Ҏ єׇӄӆӆӆіӄӇҏђ Ҋ the prompt notification to various administrative authorities, and the local law enforcement agencies, of any actual or attempted malicious act or loss concerning a source of ionising radiation or a batch of radioactive sources of category A, B łŅׇ Ҏ єׇӄӆӆӆіӅӅҏђ Ҋ the sending of documents that could facilitate malicious acts ĵŌ ņĸŃĴŅĴŇĸё ņŃĸĶļĴĿĿŌ ļķĸŁŇļĹļĸķ ŀĴļĿ Ҏ єׇӄӆӆӆіӄӆӃҏђ Ҋ the nominative and written authorisations to be delivered to the persons having access to ionising radiation sources or batches of radioactive sources in category A, B or C, transporting them, or having access to information concerning the protection of such sources or batches of sources against malicious acts Ҏ єׇӄӆӆӆіӄӇӋҏє Ł ӅӃӄӌё ŇĻĸ ŊłŅľļŁĺ ĺŅłňŃ ĶłłŅķļŁĴŇĸķ ĵŌ ŇĻĸ łĹ ŇĻĸ Ministry responsible for the environment and in which ASN participates, continued and finalised its work to prepare a draft Ministerial Order setting technical and organisational requirements to protect ionising radiation sources (or batches of sources) against malicious acts. This work drew on the findings ŀĴķĸ ķňŅļŁĺ ņłŀĸ ӅӈӃׇŃŅĸŃĴŅĴŇłŅŌ ʼnļņļŇņ ĶłŁķňĶŇĸķ ĵŌ ĵĸŇŊĸĸŁ ӅӃӄӄׇĴŁķ ӅӃӄӉє Ň ŇĻĸ ĸŁķ łĹ ŇĻĸ ĹļŅņŇ ńňĴŅŇĸŅ łĹ ӅӃӄӌё some industry players and stakeholders were invited to give their comments and observations on a preliminary draft. This resulted in numerous improvements to the texts. This draft received a favourable opinion from ASN on ӅӉׇ ĸŃŇĸŀĵĸŅ ӅӃӄӌё ņňĵĽĸĶŇ Ňł Ĵ ĹĸŊ ŀļŁłŅ ŀłķļĹļĶĴŇļłŁņ Ҏ łŃļŁļłŁ ӅӃӄӌі іӃӆӆӌׇłĹ ӅӉׇ ĸŃŇĸŀĵĸŅ ӅӃӄӌҏђ ŇĻĸ ļŁļņŇĸŅļĴĿ ŅķĸŅ ŊĴņ ņļĺŁĸķ łŁ Ӆӌׇ łʼnĸŀĵĸŅ ӅӃӄӌׇĴŁķ ŃňĵĿļņĻĸķ łŁ ӄӄׇ ĸĶĸŀĵĸŅ ӅӃӄӌє Ň ŊļĿĿ ĸŁŇĸŅ ļŁŇł ĹłŅĶĸ łŁ ӄׇ ĴŁňĴŅŌ ӅӃӅӃׇĹłŅ new sites and, for already licensed sites, in two stages: the łŅĺĴŁļņĴŇļłŁĴĿ ĴŁķ ĻňŀĴŁ ŃŅłʼnļņļłŁņ ŊļŇĻļŁ ӉׇŀłŁŇĻņ ĴŁķ ŇĻĸ ņŌņŇĸŀņ ĹłŅ ŃŅłŇĸĶŇļłŁ ĴĺĴļŁņŇ ŀĴĿļĶļłňņ ĴĶŇņ ӄӋׇŀłŁŇĻņ ĿĴŇĸŅє The Order covers both the installations and transport. The requirements aim more specifically, on the basis of a graded approach associated with categories A, B, C and D, to set up an in-house organisation addressing security matters to: Ҋ limit or delay the theft of radioactive sources through access control measures, reinforcement of physical barriers and their openings (doors, windows) and protection of information (access limited to duly authorised persons); Ҋ detect an actual or attempted malicious act (theft in particular) as early as possible; Ҋ take action or alert the local law enforcement agencies after preparing their on-site actions. These security principles are based on physical systems (barriers, access control, boundary-crossing detection, alarms, etc.) and organisational measures (security policy, training, equipment verifications, exercises, records, etc.) necessary for overall protection effectiveness. łŅ łĵʼnļłňņ ŅĸĴņłŁņ Ňł ŅĸņŇŅļĶŇ ĴĶĶĸņņ Ňł ņĸŁņļŇļʼnĸ ļŁĹłŅŀĴŇļłŁё some of the provisions of this Order were not published in the Journal Officiel (Official Journal). ASN has therefore informed individually all the persons/entities responsible for nuclear activities that it regulates. The following conclusions can be drawn: ཛྷ The classification of radioactive sources or batches of sources into the different categories has been carried out on slightly less than half the facilities ٢ ۏאג ǔȒȸ Ɏǝƺ ǣȇƳɖɀɎȸǣƏǼ ɀƺƬɎȒȸ ƏȇƳ ۏבד ǔȒȸ Ɏǝƺ ȅƺƳǣƬƏǼ sector), while the remaining facilities have applied Ɏǝƺ ƬǼƏɀɀǣǔǣƬƏɎǣȒȇ ȒȇǼɵ ȵƏȸɎǣƏǼǼɵ ٢ ۏזא ƏȇƳ ג ׎ ۏ ȸƺɀȵƺƬɎǣɮƺǼɵ٣ً Ȓȸ ȇȒɎ ƏɎ ƏǼǼ ٢ ב ׎ ۏ ƏȇƳ ۏה ȸƺɀȵƺƬɎǣɮƺǼɵ٣ِ ཛྷ The individual authorisations that the person responsible for the nuclear activity must issue to grant access to these radioactive sources or batches of sources, their transportation or access to the information relative to the means or measures for protecting them, have been granted to only a small ƺɴɎƺȇɎِ…ȇǼɵ ב ׎ ۏ Ȓǔ Ɏǝƺ ǣȇƳɖɀɎȸǣƏǼ ǔƏƬǣǼǣɎǣƺɀ ǝƏɮƺ ǣɀɀɖƺƳ such authorisations and no medical centre has issued them satisfactorily. The provisions are partially satisfied Ȓȇ א ׎ ۏ Ȓǔ Ɏǝƺ ǣȇƳɖɀɎȸǣƏǼ ǔƏƬǣǼǣɎǣƺɀ ƏȇƳ א ׎ ۏ Ȓǔ Ɏǝƺ ȅƺƳǣƬƏǼ centres: the authorisations are thus only issued to some of the people who need them or without considering Ɏǝƺ ȸƺƏǼ ȇƺƺƳɀ ɎȒ ǝƏɮƺ Ɏǝƺȅِ Xȇ Ɏǝƺ ȒɎǝƺȸ ƬƏɀƺɀ ٢ ד ׎ ۏ ƏȇƳ ז ׎ ۏ ȸƺɀȵƺƬɎǣɮƺǼɵ٣ً ȇȒ ƏɖɎǝȒȸǣɀƏɎǣȒȇ ɯƏɀ ǕȸƏȇɎƺƳِ ཛྷ Nevertheless, the measures taken to prevent unauthorised access to the sources were deemed satisfactory for the large majority of industrial ǔƏƬǣǼǣɎǣƺɀ ٢ ۏוח ٣ً ɯǝƺȸƺƏɀ ǣȇ Ɏǝƺ ȅƺƳǣƬƏǼ ɀƺƬɎȒȸ ȒȇǼɵ ɀǼǣǕǝɎǼɵ ȅȒȸƺ ɎǝƏȇ Ə ɎǝǣȸƳ Ȓǔ Ɏǝƺ ƬƺȇɎȸƺɀ ٢ ۏזב ٣ ɎȒ ژ ƳƏɎƺ meet the applicable measures. This situation will obvioulsy change once the protection systems (physical in particular) prescribed by the Order of ژחא zȒɮƺȅƫƺȸ אژ ׎׏ ח ȸƺǼƏɎǣɮƺ ɎȒ Ɏǝƺ ȵȸȒɎƺƬɎǣȒȇ Ȓǔ ǣȒȇǣɀǣȇǕ radiation sources and batches of sources in categories A, B, C and D against malicious become applicable. ཛྷ Lastly, the majority of the source inventories held by the facilities are consistent with the national inventory held by IRSN (complete correspondence ǣȇ ۏאוژ Ȓǔ ƬƏɀƺɀ ǔȒȸ Ɏǝƺ ǣȇƳɖɀɎȸǣƏǼ ɀƺƬɎȒȸ ƏȇƳ ۏבו ǔȒȸ ژ Ɏǝƺ ȅƺƳǣƬƏǼ ɀƺƬɎȒȸ٣ً Ɏǝɖɀ ƏǼǼȒɯǣȇǕ ȸƏȵǣƳ ǣƳƺȇɎǣǔǣƬƏɎǣȒȇ of the holding entity and site if necessary.
